Wedding Photography & Videography Agreement And Terms of Agreement:
The Agreement institutes an order for wedding photography & videography services as agreed by both parties: Freya Ronaldson & Alan Ronaldson: Noteworthy Photography & Film ("the photographer(s) & videographer(s)") and the contracting party ("the client"). It is mutually agreed that the Photographer which means both Freya & Alan Ronaldson, shall provide services and/or goods as specified and that the client shall pay the amount due for the sold services and/or goods on the due date as described within the agreement.
The photographer and at times her assistant shall be the sole professional (still) photographer(s) at the venue specified. Family, friends and other guests are however positively encouraged to take photographs throughout the day, provided that they do not affect the photographer from taking and producing the images she requires, this includes any persons/Amateurs/DSLR users who are friends/family or otherwise. If more than this companies still photographer(s) are present or, and have been professionally paid for services, or an amateur photographer is impacting the work of the photographer & her assistant, the photographer and assistant has the right to refuse to continue with coverage at the wedding, as shots may be impeded by the attendance of another photographer be it professional or amateur.
A deposit ("the deposit") is required at the time of booking. Payment of the deposit secures the time and services of the photographer on the date of the wedding ceremony. However, dates are only reserved once the deposit is received in cleared funds. Payment of the deposit can be made by bank transfer, cheque. The deposit is non-refundable. By paying the deposit you are agreeing to the terms set out in the agreement.
The balance of the wedding package is to be paid no later than 6 weeks before the day of the wedding.
EDITING OF PHOTOGRAPHS TIME SPAN
The Client(s) photographs will be edited and supplied on USB, within 4- 10 weeks of their wedding day. Please allow this time, before contacting the photographer, especially during busy periods. After your wedding date, the photographer will contact you with an estimated time of delivery.
The photographer shall be granted creative and artistic license in relation to the choice of locations and poses used. The photographer's judgment on photographic style and the number of photographs taken shall be deemed correct. Style and number of photographs are dependent on changes of the weather, time of year/day and availability of and willingness of subjects. The Photographer will endeavour to honour requested photographs but does not undertake to guarantee any specific photograph nor incorporate any specific background, location or group arrangement.
The photographer alongside the client has copyright for printing and sharing online, throughout the world. The photographer grants the clients license to use the images for personal display purposes and printing as many times as desired. Editing of photos, are not permitted.
IMAGES & DISPLAY
The Photographer reserves the right to use the digital images for advertising, display, internet promotions, publications or other purposes. The Photographer may display any photographs included in this contract in his/her studio, portfolio, literature, display areas exhibitions, competitions, advertising or slide shows, and websites unless otherwise agreed by the parties involved.
All images are nominal. Although the photographer will endeavour to produce more images than is discussed with the client, thee is no guarantee that any particular number of images will be produced. The photographer cannot guarantee exact colour matching due to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. The client acknowledges that it is sometimes impossible to record the exact colour as seen by the human eye.
The photographer will perform retouching at her discretion.
NON-EDITING FILES SUPPLIED
JPEG files are supplied to client after editing has taken place. Please note, 'RAW' i.e unedited files are not supplied to the client as they are copyright to the photographer during the RAW file stage. JPEG files are the delivery format to the client on USB and are edited & supplied at the Photographers discretion. You will not (being the client) receive the unedited 'RAW' files.
LIMITATION OF LIABILITY
The agreement is subject to alteration or cancellation by the photographer owing to any cause/s beyond her reasonable control, including but not limited to an act of God, fire, war, road closure, total photographic failure, injury or sickness ("a Force Majeure Event"). The photographer's liability in the case of a Force Majeure Event shall be limited to a full refund of the monies paid. Thee limitation on liability shall also apply in the event that the photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the postal system, or otherwise lost or damaged. In the event that photographer fails to perform for any reason, the photographer shall not be liable for any amount in excess of monies already paid. Your statutory rights are not affected.Neither party to thee agreement shall be liable for indirect or consequential loss.
In the unlikely event of the assigned photographer being unable to attend the agreed wedding due to unforeseen circumstances, NDM Photography reserves the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding to the best of his/her ability.
In the unlikely event of a total photographic failure or cancellation of contract by either party in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect of consequential loss.
IMAGES & VIDEO SUPPLIED ON USB/DISC
The client agrees to the format (USB/DISC/ONLINE) specified when booking and when dating contact above, in which the receipt of images & video are formatted to. In the event of a client being unable to get a USB/DISC format to work with their equipment, the responsibility for the format issue lies with the client (unless stated when booking) as all images & videography footage is professionally quality controlled with various devices i.e: Mac, PC, TV, Smart TV, Tablets etc, prior to delivery of photography & videography to our client. In the very rare event of the format not working at the clients address/with their equipment, and with the result being another copy/format of images & video has to be made for delivery, an additional charge of £20 per format will be applied.
The client may cancel thee agreement at any time by giving written notice to the photographer. In all instances, notification of cancellation will be effective on the date received by the photographer. If cancelled within the final 6 week period leading up to the wedding then the full 100% of the fee will be forfeited by the client.
Should the client wish to postpone the wedding then, subject to the photographer's availability, all monies paid may be applied to the new wedding date. In thee case, the total fees chargeable shall be fees that apply at that time. In the event that the photographer is unable to take another wedding booking on the clients cancelled or postponed date then the above cancellation fees will apply. The photographer recommends wedding insurance so that any unforeseen events are covered.
Any complaints should be raised by the client with the photographer in writing, within 21 days of first becoming aware of the matter to be complained of and in any event within 21 days of receipt of the images.
SPECIFIC VIDEOGRAPHY TERMS:
Package: The package includes; Videography of wedding package as listed above. Unless changed prior to event.
The wedding will be filmed to the customers requirements and or in the style as seen by the clients from samples shown prior to booking on our website.
Restrictions: The videographer will endeavour to shoot technically and artistically crafted footage, but the videographer cannot be held responsible for bad weather, poor lighting at venues or lack of co-operation from, or restrictions imposed by, all or relevant authorities, e.g. Church or Registry officials or any other party present on the day.
Copyright & Usage: This contract constitutes an order for videography services. It is understood that all proofs, digital images, and samples remain the property of the videographer and they may be used for advertising, display or any purpose thought proper by the Videographer. The Client will be able to purchase more DVD''s from the videographer if required at an extra cost, however the DVD's/ videos may not be used (without prior permission from the videographer) for commercial use.
Indemnity.Liability: Although all care will be taken with the footage shot at the event, the videographer limits any liability for loss, damage or failure to deliver any footage, for any reason, to the return of all fees paid.
Change of event date: In the case of a change in date of event, the videographer may allow the booking to be moved to the new date if this date is free in their diary and at their sole discretion.
Acts of God: The videographer will not be held liable in the event of fire, strike, casualty, act of God, or other cause beyond the control of the parties. If due to illness, then the videographer shall refund all payments to the Client, but shall have no further liability with respect to the agreement.
Inclement weather: The videographer will not be held liable in the event of environmental conditions beyond their control and reserves the right to decline videography outdoors in inclement weather.
Inherent defects: The videographer is not liable for damages, including but not limited to, delay or omission arising from inherent equipment defects or fault, or other causes beyond their control. Liability in any event is limited to the refund of all videography fees paid.
Extenuating circumstances: In the event that the videographer is unable to attend the wedding the videographer in such circumstances will assist in finding a replacement videographer, but if one cannot be found then and only then will a full refund of all money paid by the client to the videographer be made, nor can the videographer be held liable in any way for the actions of, or quality of the work by the replacement videographer.
Once a deposit and full balance is paid, it is non-refundable. Cancellation must be in writing.
Damage of Equipment: In the event any of the videographers equipment is damaged or destroyed, either accidentally or unintentionally, by the Client, event guests and attendants, or employees of the Client, the Client is fully responsible for the equipment’s replacement at current market prices.
Your wedding film & highlights will be fully edited within 12 weeks of your wedding day.
This agreement shall be governed in accordance with the Laws of England and Wales.
The Terms of this contract are accepted by the Photographer and the client.
