Wedding Videography Agreement And Terms of Agreement:
VIDEO SUPPLIED ON USB/DISC
The client agrees to the format (USB/DISC/ONLINE) specified when booking and when dating contact above, in which the receipt of the video are formatted to. In the event of a client being unable to get a USB/DISC format to work with their equipment, the responsibility for the format issue lies with the client (unless stated when booking) as all images & videography footage is professionally quality controlled with various devices i.e: Mac, PC, TV, Smart TV, Tablets etc, prior to delivery of videography to our client. In the very rare event of the format not working at the clients address/with their equipment, and with the result being another copy/format of video has to be made for delivery, an additional charge of £30 per format will be applied.
A deposit ("the deposit") is required at the time of booking. Payment of the deposit secures the time and services of the Videographer on the date of the wedding ceremony. However, dates are only reserved once the deposit is received in cleared funds. Payment of the deposit can be made by bank transfer, cheque. The deposit is non-refundable. By paying the deposit you are agreeing to the terms set out in the agreement.
The client may cancel thee agreement at any time by giving written notice to the videographer. In all instances, notification of cancellation will be effective on the date received by the videographer. If cancelled within the final 6-week period leading up to the wedding then the full 100% of the fee will be forfeited by the client.
Should the client wish to postpone the wedding then, subject to the videographer's availability, all monies paid may be applied to the new wedding date. In this case, the total fees chargeable shall be fees that apply at that time. In the event that the videographer is unable to take another wedding booking on the clients cancelled or postponed date then the above cancellation fees will apply. The videographer recommends wedding insurance so that any unforeseen events are covered.
Any complaints should be raised by the client with the videographer in writing, within 21 days of first becoming aware of the
matter to be complained of and in any event within 21 days of receipt of the images.
SPECIFIC VIDEOGRAPHY TERMS:
Package: The package includes; Videography of wedding package as listed above. Unless changed prior to event.
The wedding will be filmed to the customers requirements and or in the style as seen by the clients from samples shown prior to booking on our website.
Restrictions: The videographer will endeavour to shoot technically and artistically crafted footage, but the videographer cannot be held responsible for bad weather, poor lighting at venues or lack of co-operation from, or restrictions imposed by, all or relevant authorities, e.g. Church or Registry officials or any other party present on the day.
Copyright & Usage: This contract constitutes an order for videography services. It is understood that all proofs, digital images, and samples remain the property of the videographer and they may be used for advertising, display or any purpose thought proper by the Videographer. The Client will be able to purchase more DVD''s from the videographer if required at an extra cost, however the DVD's/ videos may not be used (without prior permission from the videographer) for commercial use.
Indemnity.Liability: Although all care will be taken with the footage shot at the event, the videographer limits any liability for loss, damage or failure to deliver any footage, for any reason, to the return of all fees paid.
Change of event date: In the case of a change in date of event, the videographer may allow the booking to be moved to the new date if this date is free in their diary and at their sole discretion.
Acts of God: The videographer will not be held liable in the event of fire, strike, casualty, act of God, or other cause beyond the control of the parties. If due to illness, then the videographer shall refund all payments to the Client, but shall have no further liability with respect to the agreement.
Inclement weather: The videographer will not be held liable in the event of environmental conditions beyond their control and reserves the right to decline videography outdoors in inclement weather.
Inherent defects: The videographer is not liable for damages, including but not limited to, delay or omission arising from inherent equipment defects or fault, or other causes beyond their control. Liability in any event is limited to the refund of all videography fees paid.
Extenuating circumstances: In the event that the videographer is unable to attend the wedding the videographer in such circumstances will assist in finding a replacement videographer, but if one cannot be found then and only then will a full refund of all money paid by the client to the videographer be made, nor can the videographer be held liable in any way for the actions of, or quality of the work by the replacement videographer.
Once a deposit and full balance is paid, it is non-refundable. Cancellation must be in writing.
Damage of Equipment: In the event any of the videographers equipment is damaged or destroyed, either accidentally or unintentionally, by the Client, event guests and attendants, or employees of the Client, the Client is fully responsible for the equipment’s replacement at current market prices.
Your wedding film & highlights will be fully edited within 12 weeks of your wedding day.
This agreement shall be governed in accordance with the Laws of England and Wales.
The Terms of this contract are accepted by the Videographers and the client.
